1. Who we are
This website is operated by Telford Marketing (“we”, “us”, “our”). We are the controller of the personal information described in this policy, which means we decide how and why it is used. Our contact details are at the end of this page.
This policy applies to information we collect through this website and when you contact us by email, telephone, WhatsApp or social media. It is written to meet the UK General Data Protection Regulation (“UK GDPR”), the Data Protection Act 2018 and the Privacy and Electronic Communications Regulations 2003 (“PECR”).
When we deliver services to a client and handle personal information on that client’s behalf (for example, the client’s own customer or website data), we act as the client’s processor. That work is governed by our written agreement with the client, not by this policy.
2. Information we collect
Information you give us
- Inquiry form. Your name, work email address, telephone number, company name or website, the services you are interested in, your estimated budget range and anything you write in your message.
- Direct contact. Anything you send us by email, telephone, WhatsApp or social media, including your contact details and the content of the conversation.
- Client relationship. If you become a client: contact details for you and your colleagues, billing details, project materials, and records of our work and communications with you.
Information collected automatically
- Form details. When you submit the inquiry form we also record the page you submitted it from and how long the form took to complete. We use the timing only to tell genuine inquiries from automated spam.
- Campaign information. If you arrive through an advert or a tagged link, the campaign details in that link (such as its source, medium and campaign name, and any advertising click reference) are held in your browser for the length of your visit and are sent to us only if you submit the inquiry form.
- Server logs. Like most websites, our hosting provider automatically records technical details of each request, such as IP address, browser type, the page requested and the date and time. These logs are used to keep the website secure and working.
We do not ask for, and ask you not to send us, sensitive information such as details about your health, beliefs or criminal record. This website is intended for businesses and is not directed at children.
3. How we use it and our lawful bases
We only use personal information where the law allows us to. The table sets out what we do and why.
| What we do | Lawful basis |
|---|---|
| Reply to your inquiry, send an automatic confirmation that we received it, and prepare a proposal or quote. | Taking steps at your request before entering into a contract; our legitimate interest in responding to people who contact us. |
| Provide our services to clients, manage projects and send service communications. | Performing our contract with you. |
| Invoice, keep accounts and meet tax and regulatory duties. | Complying with our legal obligations. |
| Protect the website, filter spam, and prevent and investigate misuse. | Our legitimate interest in keeping our website and business secure. |
| Understand which marketing brings in inquiries, using the campaign information described above. | Our legitimate interest in measuring and improving our own marketing. |
| Measure how the website is used with Google Analytics. | Our legitimate interest in understanding how our website is used so that we can improve it. You can opt out as described in section 4. |
| Send occasional updates about our services to business contacts and existing clients. | Our legitimate interest in promoting our services, or your consent where the law requires it. You can opt out at any time. |
| Publish testimonials, logos or examples of work. | Your consent or our agreement with you. You can ask us to remove them. |
| Establish, exercise or defend legal claims. | Our legitimate interest in protecting our legal position. |
Where we rely on legitimate interests, we have weighed them against your rights and expectations. You can object to this use at any time (see Your rights). We do not make decisions about you by automated means that have a legal or similarly significant effect, and we do not sell personal information.
4. Cookies and similar technologies
Analytics
We use Google Analytics, a service provided by Google, to understand how visitors use this website, for example which pages are viewed and how visitors arrive. Google Analytics sets the following cookies on your device when you visit:
| Cookie | Purpose | Duration |
|---|---|---|
_ga | Distinguishes one visitor from another using a randomly generated identifier. | Up to 2 years |
_ga_CDEPZ47Z58 | Keeps track of your visit (session) for our Google Analytics property. | Up to 2 years |
Google Analytics also receives technical information such as your approximate location (derived from your IP address, which Google does not store), device and browser type, and the pages you view. We use it in aggregate and do not use it to identify you. Google processes this information on our behalf and may do so outside the UK; see International transfers.
You can stop Google Analytics from collecting information about your visits by blocking or deleting cookies in your browser settings, or by installing theGoogle Analytics opt-out browser add-on. The website works normally without these cookies.
Embedded video
Our home and About pages show a video that is hosted by YouTube, a service provided by Google, using YouTube’s privacy-enhanced mode. When a page containing the video loads, your browser connects to YouTube’s servers, so Google receives technical information such as your IP address and browser details, and YouTube may store information on your device in order to play the video. Google’sprivacy policyexplains how it uses this information.
Other storage on your device
Separately from analytics, this website holds the campaign information described in section 2 in your browser for the length of your visit; it is cleared when you close the tab and is not used to identify you unless you choose to submit the inquiry form.
We do not use advertising cookies.
Links on this website to WhatsApp, Facebook and Instagram take you to services run by other companies. Once you follow a link, that company’s own privacy policy applies.
5. Who we share information with
We share personal information only where it is needed for the purposes above:
- Service providers that host this website and our email, that provide website analytics (Google), and that supply the business software we use to run our company. They act on our instructions and under contract.
- Team members and contractors who work on your inquiry or project and are bound by confidentiality.
- Third-party platforms we use to deliver client work, such as advertising, analytics, domain and hosting platforms, where a client has asked us to work with them.
- Professional advisers, such as accountants, insurers and lawyers.
- Authorities and others where we are required to by law, or where it is necessary to protect our rights or the safety of others.
- A buyer or successor if our business, or part of it, is sold or reorganised. The information would continue to be protected in line with this policy.
6. International transfers
We are based in the United Kingdom. Some of our service providers and contractors are located, or store data, outside the UK. Where personal information is transferred to a country that the UK government has not recognised as providing adequate protection, we put appropriate safeguards in place, such as the UK International Data Transfer Agreement or the UK Addendum to the European Commission’s standard contractual clauses. You can ask us for more information about these safeguards.
If you are located outside the UK, please be aware that your information will be processed in the UK and in the other locations described above.
7. How long we keep information
- Inquiries that do not lead to work with us: up to 24 months after our last contact with you, so that we can pick the conversation back up if you return.
- Client records, contracts and invoices: for six years after the end of the financial year in which our work for you finished, to meet tax and accounting rules and to deal with any claims.
- Marketing contacts: until you opt out or we have had no engagement from you for 24 months.
- Server logs: for the period set by our hosting provider, usually no more than a few months.
We may keep information for longer where the law requires it or where it is needed for a legal claim. When information is no longer needed we delete it or anonymise it.
8. How we protect information
We use technical and organisational measures appropriate to the information we hold. These include encrypted connections to this website, access restricted to the people who need it, password-protected systems and care in choosing our suppliers. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If a breach is likely to put your rights at risk, we will tell you and the regulator as the law requires.
9. Your rights
Under UK data protection law you have the right to:
- Access the personal information we hold about you and receive a copy of it.
- Correct information that is inaccurate or incomplete.
- Erase your information in certain circumstances.
- Restrict how we use your information in certain circumstances.
- Object to our use of your information where we rely on legitimate interests, and at any time to its use for direct marketing.
- Data portability: receive information you gave us in a commonly used, machine-readable format, where we process it by automated means on the basis of consent or contract.
- Withdraw consent at any time, where we rely on consent. This does not affect anything done before you withdrew it.
To use any of these rights, email contact@telfordmarketing.co.uk. We may need to confirm your identity. We will respond within one month; if a request is complex we may extend this and will tell you why. There is normally no charge.
If you are in the European Economic Area or another country with its own data protection law, you may have similar or additional rights under that law, and we will respect them where they apply to us.
10. Questions and complaints
If you have a question or concern about how we handle your information, please contact us first so that we can try to put it right. We will acknowledge a complaint within 30 days and respond without undue delay.
You also have the right to complain to the UK regulator, the Information Commissioner’s Office (ICO), atico.org.uk/make-a-complaintor on 0303 123 1113. If you live outside the UK, you may also be able to complain to your local data protection authority.
11. Changes to this policy
We may update this policy from time to time, for example when we change the tools we use or when the law changes. The date at the top of this page shows when it was last revised. If a change significantly affects how we use your information, we will take reasonable steps to let you know.
